The first witness told police that Jane Doe seemed “coherent” to him and not “so intoxicated that she could no longer take care of her own safety” at the hotel bar, according to the police report.

That witness also said Jane Doe and another unidentified woman — who Hegseth allegedly asked to go back to his room — were flirting with Hegseth at the bar by touching his arm.

A police officer reviewed available hotel security footage and observed Hegseth and Jane Doe exiting the adjoining hotel bar “with their arms locked together” and noted that “both did not have an unsteady gait.” .

The unidentified woman whom Hegseth chased to the bar before meeting up with Jane Doe told police that Jane Doe did not look or act like someone who was intoxicated when they met for the last time that night after the bar closed. The witness added that Jane Doe behaved normally the next day and did not act like she was hungover or out of sorts.

At one point, after Hegseth and Jane Doe left the hotel bar, the two men got into an argument near the hotel pool, prompting other guests to file noise complaints given the time of night the commotion occurred, according to the police report. The man working the front desk at the time went to the pool to resolve the issue.

While speaking with Jane Doe and Hegseth, the receptionist noted that Hegseth appeared rather intoxicated, while Jane Doe was “not drunk, was standing alone and was very coherent,” according to the police report. The receptionist said Jane Doe then placed her hand and arm on Hegseth’s back and escorted him away from the scene.

Hegseth told police he did not remember any arguments at the hotel pool or being belligerent with anyone, according to the report.

Notably, Jane Doe’s husband and children were also staying at the same hotel that weekend, and he and Jane Doe were exchanging text messages that night, according to the police report. He eventually became worried about his wife and went looking for her in the hotel grounds, but was unable to find her.

Subsequently, around 4 a.m., Jane Doe returned to the hotel room where she was staying with her husband and entered, later telling police that she did not remember how she got home , according to police. report. Jane Doe told her husband that she had accidentally fallen asleep elsewhere, and her husband noticed that she “had no difficulty walking and she had no difficulty speaking.”

Jane Doe and her husband had sex the Monday after the weekend conference, which Jane Doe said reminded her of the encounter with Hegseth and ultimately prompted her to take an examination for sexual assault.

Hegseth told police the encounter was completely consensual and that he maintained dialogue with Jane Doe throughout to ensure her consent had not changed. Without elaborating, Hegseth told police he saw “the first signs of regret” on Jane Doe’s part shortly after they finished having sex.
