Harris rips Trump for comments about women

In a filing Wednesday evening, Elon Musk requested that the lawsuit against his $1 million donation be moved to federal court, arguing that the allegations “primarily revolve around the allegation that the defendants are interfering in a manner or another illegally with a federal election.”

Philadelphia District Attorney Larry Krasner accused Musk and its America PAC for running an illegal lottery and violating state consumer protection laws.

The filing specifically states “this is not a matter” as to whether or not Musk violated state or federal laws that prohibit vote buying.

But Musk’s filing Wednesday notes the lawsuit’s repeated references to the upcoming presidential election. This includes Krasner’s claim that Musk and his PAC “developed their illegal lottery scheme to influence voters in this election.”

“The complaint, in truth, has little to do with the nuisance and consumer protection claims made by state law,” Musk’s attorney wrote in his filing.

“To the contrary, although disguised as state law, the purpose of the complaint is to prevent by any means Defendants’ alleged ‘interference’ in the upcoming federal presidential election.”

The filing argues that any order in this case “would require judicial intervention in the conduct of a current federal election” — a move they say is not permitted.

The filing comes ahead of a Thursday morning hearing in Philadelphia on the issue.
