EPD accuses parents of neglect; drugs recovered following narcotics investigation

HENDERSON, Ky. (WEHT) – Two Evansville residents were arrested and charged with negligence Thursday following a drug investigation at a Cherry Street apartment.

According to an affidavit, investigators made two purchases of cocaine from Troy Ogburn, 42, during the month of October. Authorities say video evidence obtained during one of those purchases shows a 1-year-old child was present at the time.

After obtaining a search warrant for the residence, officers say they conducted a traffic stop on Ogburn after he was seen leaving the building with the 1-year-old. After taking him into custody, officers said they were able to find a ledger containing several nicknames and dollar amounts as well as $4,572 on Ogburn.

While executing the search warrant at the residence, officers said the apartment contained children’s toys and clothing “scattered” as well as a large playpen. An affidavit states the following items were recovered from the apartment during the search:

  • Stolen handgun found in cabinet above stove.
  • Two more handguns found in the kitchen.
  • A backpack found in the kitchen containing a large quantity of methamphetamine, fentanyl and suspected fentanyl pills.
  • Five bags in a backpack containing a crystal substance that tested positive for methamphetamine with a combined weight of 1,921.2 grams.
  • A bag in a backpack containing pressed pink powder that tested positive for fentanyl and weighing 143 grams.
  • Three bags in a backpack containing pink and blue pills that tested positive for fentanyl with a combined weight of 332.6 grams.
  • 13 bags found in kitchen containing material tested positive for THC with a combined weight of 519.7 grams.
  • A bag found in the kitchen containing $950 and an off-white “rock-like” substance that tested positive for cocaine and weighing 25 grams.
  • A bag found in the kitchen containing $125 and two bags containing white pills identified as Alprazolam, a Schedule IV substance, with a field weight of 50 grams.
  • A bag found in the kitchen containing a paper register with names and dollar amounts and two clear plastic bags containing pink fentanyl pills weighing 14.8 grams.
  • A bag found in the kitchen containing white pills identified as oxycodone, a Schedule II narcotic, with a field weight of 7.4 grams.
  • A clear plastic bag found in the kitchen containing pink fentanyl pills weighing 1 gram.
  • Two digital scales containing residue found in a kitchen drawer.
  • Several rounds of ammunition.

While officers were searching the apartment, authorities say Champagne Josenberger, 36, arrived on the scene. Josenberger allegedly told authorities that she and Ogburn, along with their two children, were staying at multiple residences while they had their home renovated. According to an affidavit, Josenberger denied they were residing at the CHerry Street apartment, but admitted they had mail and clothing belonging to them inside the apartment.

During an interview with task force agents, Ogburn allegedly told agents that he, Josenberger and their two children lived in the apartment “off and on” while their home was being renovated. Authorities say he also admitted that investigators would find more than three pounds of methamphetamine, several ounces of fentanyl and three firearms in the apartment. Ogburn reportedly said the weapons were not his, but he handled them all despite being prohibited from doing so.

Ogburn was charged with trafficking methamphetamine, neglect of a dependent person, trafficking cocaine or narcotics, trafficking marijuana and possession of a firearm by a felon. Josenberger was accused of negligence. They were both booked into the Vanderburgh County Jail where they are being held without bail.
