At special prosecutor’s request, judge suspends further deadlines in Trump election interference case

Former President Donald Trump’s federal court judge election interference case has suspended all upcoming deadlines in the case, after special counsel Jack Smith filed a motion Friday requesting a pause so his office can “determine the appropriate path forward” in this “unprecedented circumstance.”

As ABC News previously reported, Smith and the Justice Department are in talks on how best to end the election affair and its classified documents affair, following Trump’s election victory on Tuesday.

The decision is based on the Justice Department’s long-standing policy that a sitting president cannot be subject to criminal prosecution while in office, sources said.

“Following the election held on November 5, 2024, Defendant is expected to be certified as President-elect on January 6, 2025, and inaugurated on January 20, 2025,” Smith’s filing released Friday states. “The Government respectfully requests that the Court waive the remaining deadlines on the pre-trial schedule to allow the Government time to evaluate this unprecedented circumstance and determine the appropriate course of action moving forward, consistent with Justice Department policy.”

“By December 2, 2024, the Government will file a status report or inform the Court of the outcome of its deliberations. The Government has consulted with defense counsel, who do not object to this request,” the filing states .

U.S. District Judge Tanya Chutkan quickly granted Smith’s request, writing: “All remaining deadlines in the pretrial calendar are VOID.” By December 2, 2024, the government must submit a status report setting out the proposed course of action in this matter. »

Trump last year pleaded not guilty to federal accusations of engaging in a “criminal scheme” to overturn the results of the 2020 election in order to stay in power.

Smith then accused Trump in a quashing the indictment this was adjusted to comply with the Supreme Court’s July ruling that Trump is entitled to immunity from criminal prosecution for official acts performed as president.

Justice Chutkan is considering how the case should proceed in light of the Supreme Court’s immunity ruling.
