Los Angeles County’s next attorney general will likely seek to delay the Menendez brothers’ resentencing case at a hearing in December as he seeks to review the facts and evidence in the decades-old case, according to several sources close to the elected district attorney of Los Angeles County. Nathan Hochman told NBC News.

The sources said “there is a good chance” that Hochman will request a postponement to a later date. scheduled for December 11 audience.

Hochman said he wants to become thoroughly familiar with the relevant facts, evidence and law. That involves reviewing each brother’s confidential records and transcripts from both trials, as well as speaking to prosecutors, law enforcement, defense attorneys and victims’ family members.

“Before I can make a decision regarding the Menendez brothers’ case, I will need to become thoroughly familiar with the relevant facts, evidence and law,” Hochman said. “Only then can I make a decision.”

Hochman was projected to win district attorney’s race against incumbent George Gascón, who announced his intention weeks before Election Day to reinvestigate the 1989 murder case. The brothers, Erik and Lyle, are serving life sentences without possibility of parole for the gun killings of their parents in the family’s Beverly Hills home.

One aspect of Hochman’s study will focus on note of new conviction filed by Gascón prosecutors recommending changing the sentence of life without parole for both brothers to two counts of first-degree murder for each which, if accepted by the court, would allow them both to be immediately eligible for parole.

The Los Angeles District Attorney said he would like to see the Menendez brothers help other young men who have suffered trauma if they were released. Robert Kovacik reports for NBC4 News at 6 p.m. Thursday, October 24, 2024.

Prior to the filing of this motion, there was an internal debate within the DA’s office about whether to seek a new conviction for voluntary manslaughter. This could have led to the brothers’ immediate release, but the argument did not prevail as prosecutors ultimately filed a new conviction on the first-degree murder charges.

Gascón’s campaign released a statement Wednesday saying the prosecutor spoke with Hochman to congratulate him on the election.

“I am deeply proud of what we have accomplished over the past four years and grateful to the communities who have been and always will be at the heart of criminal justice reform,” the statement said.
