Draft order: No questions to be raised regarding the formation of the interim government

The mandate of the caretaker government will last until the new prime minister takes office after the formation of the 13th National Parliament.

The draft order states that any shortcoming in the formation of the caretaker government, appointment of the chief advisor or any other advisor will not make any of their actions illegal for that reason alone. No question on this matter can be raised in court, nor can any lawsuit be filed, reports Prothom Alo citing provisional government sources.

With these provisions, the draft interim government order has been finalized. Although the project was approved at the Sept. 19 Board of Selectmen meeting, it has not yet been released as an ordinance. It is now awaiting publication.

Facing a student-led uprising, the Awami League government was overthrown on August 5. The next day, the president dissolved the 12th National Parliament. On August 8, after consultation with the Appellate Division, Dr. Muhammad Yunus was appointed senior advisor and the interim government was formed. On that day, the president administered the oath of office to the chief advisor and other advisors.

According to government sources, the competent authority must address the constitutional crisis and empower the caretaker government to exercise the executive functions of the state in the current situation. This order is issued for this purpose and the President will publish it.

The draft order does not, however, specify the exact number of advisers to the interim government. It stipulates that the interim government will be composed of a principal adviser and as many advisers as the principal adviser deems necessary. The President shall appoint a person of repute and repute as Chief Advisor, and other advisors shall be appointed on the advice of the Chief Advisor, as mentioned in the draft order.

To be eligible for the position of Senior Advisor or Councilor, candidates must agree not to run in elections to the 13th National Parliament or as public representatives in any local government institution.

Currently, the interim government includes Dr. Muhammad Yunus as its senior advisor and 20 other advisors.

Concerning the exercise of the executive power of the Republic, the draft stipulates that the interim government will assist and support the Electoral Commission in organizing free, fair, neutral and participatory elections for members of Parliament, as well as in carrying out all other prescribed task. by the Constitution or other laws.

According to the draft order, irrespective of any provision of the Constitution or other laws in force, all powers exercised, orders issued, rules and regulations made, notifications, orders, activities and measures taken by the caretaker government during the period between its formation and the date on which the new Prime Minister takes office (including both dates) will be deemed to have been lawfully executed. Neither the Supreme Court nor any other court or authority shall have the power to question their legality or declare them invalid or void.
