Construction company fined after telehandler dies

A construction company has been fined £160,000 after a telehandler overturned on one of its sites, killing a construction worker.

A statement released by the Health and Safety Executive (HSE) says Scott Bradley was driving a telehandler on a house building site in Glasgow in May 2022 when it overturned.

The statement describes a case heard at the Sheriff Court on Tuesday (November 12).

The HSE said the telehandler overturned when it slid down an embankment and Bradley, then aged 44, died at the scene.

An investigation by the HSE found that Merchant Homes Partnership, the main contractor which had employed Bradley at the Stepford Road site, “failed in its duty to properly assess the risks and introduce measures to ensure that the “the traffic route was adapted” to the telescopic forklift.

According to the HSE, Merchant Homes Partnership Ltd, of George Square, Glasgow, pleaded guilty to breaching regulation 27(2) of the Construction (Design and Management) Regulations 2015. It was fined 160 000 £.

HSE Inspector James Caren said: “Our investigation found that Merchant Homes Partnership Ltd failed in its duty to properly assess the risks and introduce measures to ensure the traffic route was suitable for the telehandler being driven by Mr. Bradley.

“As a result, the wheels of the telehandler came off the edge of the travel lane when reversing, which tragically resulted in the vehicle overturning,” he added.

The company was dissolved by court decision last January.
