Sean Croft’s new terms as Starpoint superintendent

When Sean M. Croft returns to work this week, he will get his second chance to lead the Starpoint Central School District.

Thanks to the changes to his employment contract, this is also his last chance.

He already received a 3 percent raise for this year under the terms of his previous contract, but he won’t get one for the next two years, according to the agreement, a copy of which was obtained as part of a Freedom of Information Act request by The Buffalo News.

Croft is expected to return to his role as superintendent Thursday, after being on leave following a one-vehicle crash Aug. 31 in West Seneca.

The school board voted unanimously Nov. 4 to approve a revised contract with Croft, who has been Starpoint’s superintendent since 2016.

Croft has the “full support of the school board,” school board President Jeffrey Duncan said in a statement that evening. Croft has “taken responsibility” and “demonstrated commitment to personal development,” said Duncan, who noted changes were made to the contract to “ensure accountability.”

Greg Berck, an attorney representing Croft in contract negotiations, declined to comment through Croft’s defense attorney, Herbert Greenman. Croft did not respond to an email seeking comment.

Croft was scheduled to appear in West Seneca Municipal Court for his criminal case Tuesday afternoon, but a spokeswoman for the Erie County District Attorney’s Office said Croft’s defense attorney requested a postponement of the affair.

Croft’s revised contract:

• Runs through June 2027. His latest contract extension, approved in April 2023, would have kept Croft in place until April 2028.

• No longer automatically extended by one year per year, unless the school board decides not to extend it.

• Croft will be able to cash in fewer unused vacation days each year, and the value of each unused day will be reduced, Duncan said.

Croft will be subject to “immediate release” if it is determined that he is in possession or under the influence of drugs or alcohol while at work or doing his job, according to his contract .

Drug or alcohol testing is triggered if Croft is “suspected of being under the influence of alcohol or drugs (for which he does not have a prescription) while on the school grounds or during an event/activity during which he is acting in his capacity as superintendent,” according to his contract.

Any new arrest or conviction for an arrest occurring after November 4 is also grounds for immediate termination.

If Croft is tested three times and the results “conclusively determine that he was not under the influence of drugs or alcohol,” the district cannot require additional testing until the end of this CONTRACT.

If the school board intends to fire Croft, it must notify him in writing. Croft will then have three business days to submit evidence or resign. If he does not submit anything or does not resign, he will be dismissed with immediate effect.

Croft’s salary this year is $205,349. He will not receive any raise during the next two academic years.
