Our good climate, sandy beaches, vibrant nightlife, luxury resorts and diverse environment, as well as the city’s rich history, attract thousands of visitors every year. The maritime industry continues to thrive, providing tourists and locals alike with the opportunity to party and relax on the water. With the popularization of nautical tourism, the number of charter companies have increased worldwide and in the United States

However, legitimate companies offering cruises for various groups and events face a challenge: the proliferation of illegal charter operators in San Diego Bay. I started chartering my first yacht 12 years ago and was frustrated to see such a proliferation of charter boats beginning to operate without regard for laws, regulations and, most importantly, passenger safety. Sometimes this happens because drivers are unaware of the regulations, and sometimes through sheer negligence. It has become harder for legitimate charter companies to stand out among illegal operators, who offer low prices while ignoring regulations.

Legal requirements and security measures Protecting guests and other staff is part of chartering a yacht. Cruise companies must at least employ one accredited sailor, carry necessary safety equipment and have charter insurance. Unfortunately, many are still unaware of even these basic safety measures.

THE US Coast Guard urges anyone chartering a yacht to ensure the company has a merchant seaman’s qualification. In addition, the boat must be operated by a licensed captain who has a detailed security plan. Charter yacht captains must pass a physical examination every two years, and the crew must undergo regular drug tests.

Large charter boats carrying more than six passengers must have a Inspection certificate issued by the US Coast Guard. This ensures that the vessel has the appropriate emergency equipment and appropriate navigation and communications systems, ensuring the safety of passengers. The Coast Guard asks anyone to report if they encounter an operator who is not following these requirements. In 2023 alone, the San Diego Police Department and the San Diego Branch of the U.S. Coast Guard seized 185 ships for ignoring all or part of the regulations. The most common violation is the number of life jackets not matching the number of passengers.

Many people are looking for cost-effective ways to celebrate on a private yacht, but don’t know that security measures and documentation need to be requested, assuming everything is taken care of responsibly. Unfortunately, this is often not the case. I advise potential clients to at least inquire about insurance and the number of life jackets on board. Prospective clients should make a checklist and ensure that the yacht operator answers all questions and provides authentic documentation before booking and embarking.

According to nationally official statisticsby 2023, boating accidents were generally caused by operator inexperience. The leading cause of death was drowning, a total of 377 cases, including 319 deaths without life jackets. These results show why neglecting protocols can be fatal.

The marine tourism scene in San Diego is changing for the worse with the emergence of illegal operators unwilling to cooperate with established businesses.
