Elon Musk continues to be sued for misleading Trump supporters

Billionaire Elon Musk has been the subject of several class action lawsuits over allegations that his political action committee engaged in fraud by falsely telling voters they had a chance to randomly win $1 million of dollars when the winners had in fact been predetermined.

Musk created the America PAC in October to support the president-elect. Donald TrumpIt’s a presidential victory. As a member of the PAC, Musk attracted Trump supporters in battleground states by promising them a chance to win a cash prize if they disclosed their personally identifying information and signed an online petition in support of “free speech and the right to bear arms.”

From October 19 until the November 5 election, Musk distributed at least $16 million to more than a dozen winners.

"I have a surprise for you," Musk told a rally for Trump last month. “We’re going to give $1 million to people who sign the petition every day between now and the election.”

As voters flocked to try to win money, Philadelphia District Attorney Larry Krasner went to court to accuse Musk of running an illegal lottery scheme.

A A Pennsylvania judge allowed payments will continue after lawyers for Musk’s PAC successfully argued that it wasn’t actually a lottery because winners were selected “based on their suitability” to serve as carriers. PAC’s word and earned $1 million as payment.

In short: there was no random winner among the million-dollar winnings.

Now, Musk faces three lawsuits accusing him of fraud and breach of contract for lying to voters about their chances of winning.

On November 5, Election Day, Jacqueline McAferty of Arizona. filed a complaint against Musk, alleging she was deceived into providing personal information to America PAC in exchange for the false promise of being eligible to win $1 million.

“Defendants knew their statements were false at the time they were made,” the complaint states. “Defendants continued to promote the petition as a chance to win $1,000,000 ‘randomly’ while simultaneously choosing winners based on selective, predetermined criteria.

The same day, a Michigan lawyer filed a separate complaint proposed class action against Musk.

And earlier this week, Texas attorney Mark Bankston filed a lawsuit on behalf of Joy Harvick of Arizona.

“If the plaintiff had known that the lottery was not random, or that she did not have a fair chance of winning the prize, or that her selection depended on her perception of the defendants’ favor as a tool of marketing, she would not have signed or supported the agreement. America PAC and allegedly failed to provide his personally identifying information to defendants,” states the complaint obtained by HuffPost.

Attorney Josh Sanford, who represents McAferty, told HuffPost in a call that the lawsuit was not about politics, but about holding Musk accountable for his lies.

“The people who sued Musk and his PAC agree with him on very basic policy issues, but these lawsuits are not about those issues,” Sanford said. “These lawsuits are about how we are accountable to people for the promises we make, and it doesn’t matter what your politics are. As Americans, we are above lying to people to get them to do what we want them to do. »

Attorney Bankston, who previously represented the Sandy Hook families who successfully pursued conspiracy theorist Alex Jones for defamation, made this statement.

“This is America, so I’m used to people lying and cheating, but doing it in relation to an election is something I will not tolerate,” Bankston said. “We would not tolerate this behavior in a two-bit casino, and we will not tolerate it from this man.”

Bankston filed Musk earlier this year in connection with a lawsuit in which Musk is accused of falsely suggesting that a 22-year-old Jewish man was part of a neo-Nazi brawl.

Musk’s America PAC was also the subject of a separate class action lawsuit filed by PAC canvassers who allege that they did not receive the agreed salary.

Musk’s lawyer, Alex Spiro, did not respond to a request for comment.

Bankston said he plans to involve more plaintiffs in the lawsuit.

“Anyone who signed Musk’s petition thinking they had a chance of winning could make a similar claim, and I encourage them to do so,” he said.
