Uttarakhand High Court issues contempt notice to state chief secretary for non-regularization of UPNL employees

In a contempt petition filed against the state government’s failure to implement the High Court’s order to regularize UPNL employees, the Uttarakhand High Court has issued a civil contempt notice to the state court. Chief Secretary Radha Raturi to get his answer on the question.

The single bench comprising Justice Alok Kumar Verma heard the matter.

On 12.11.2018, in the case of Kundan Singh v. State of Uttarakhand and Ors. the High Court has ordered that the state government shall regularize the UPNL sponsored employees within one year in accordance with the existing schemes and ensure that they are paid the minimum pay scale with dearness allowance , including arrears, within six months.

The state government challenged the High Court’s decision in the Supreme Court, but it was dismissed. However, the petitioners claimed that despite an order, the state government is yet to frame rules for their regularization even though they have been working for years. Instead, the government removes them, issues regular notifications and recruits for these posts.

The petitioners pleaded that the State Government had not complied with the order of the Court and initiated contempt proceedings against the State.

Following this, the notice was issued to the Chief Secretary and returned on 24.12.2024.
