The case concerns alleged hate speech and racist remarks made by Gouws.

Gouws was suspended in June after a 2010 video showing him making racist comments using the K-word surfaced on social media just days after he was sworn in as a DA MP.

The South African Human Rights Commission then took Gouws to court.

The SAHRC believes that although the video was filmed in 2010, it has reignited the pain it caused when it first appeared.

The Democratic Alliance has since ended Gouw’s membership, meaning he had to give up his seat in Parliament.

Gouws will oppose the SAHRC’s request.
