Amendment 3, legalization of recreational marijuana

Amendment 3 is one of two amendments voted on by citizens and not legislators (the other being Amendment 4). Its passage would make marijuana use legal for adults over 21, define quantities, and define the commercial market for such use.

Important to consider: The amendment provides insight. If voters approve it, the Florida Legislature will then draft the specific rules, regulations and restrictions for its implementation, which may include regulating where and how, as it does for tobacco.

It’s a similar process to what happened when voters approved the amendment to legalize medical marijuana eight years ago. And Amendment 3 uses the same language as the medical marijuana amendment as its basis and framework.

Amendment 3 would allow adults 21 and older to legally purchase and possess up to 3 ounces of marijuana and use it personally. The amendment also adds who can grow and sell it. Initially, it would only be the 25 licensed medical marijuana companies with more than 600 dispensaries statewide. But Amendment 3 would allow lawmakers to also authorize non-medical entities to cultivate, acquire, transport, distribute and sell marijuana.

A legal recreational marijuana industry is expected to be big business, state analysts say. Based on sales tax projections, they predict $200 million to $400 million per year will flow to the state when legal marijuana is fully operational. There is currently no timeline to predict this.

This profit incentive could explain why the cannabis companies funding this amendment are on track to collectively spend $100 million on efforts to legalize marijuana in Florida.

Supporters also cite the savings, both personal and law enforcement, from decriminalizing personal marijuana, sparing an estimated 200,000 people each year from arrest and incarceration.

Currently, 24 states have legalized marijuana use. Voters in North and South Dakota will also decide with Florida in November.

A “yes” vote on Amendment 3 will support legalization of adult personal use of marijuana in Florida starting in mid-2025.

A “no” vote leaves current laws in place, including on the medical use of marijuana.
