The brothers say they were surprised not only by the decision that prevented Smollett from being retried, but also because he never admitted to what he had done.

They made the remark in an interview on “Fox & Friends,” speaking out about how the “sweetheart” deal State Attorney Kim Foxx gave the actor shocked them. The actor reportedly obtained a $10,000 bail forfeiture and 15 hours of community service.

Abel and Ola aren’t the only ones uneasy about the outcome of the Smollett trial. The special prosecutor in the case recently sharply reprimanded the Illinois Supreme Court after it decided to overturn the actor’s conviction on a technicality.

Dan Webb said in a statement shared with the Daily Mail that the decision “has nothing to do with Mr. Smollett’s innocence” and that “the legal reasoning upends long-standing Illinois precedent.”

“My office spent nearly two years gathering evidence and working closely with the Chicago Police Department to prepare this case for trial,” Webb continued in his remark. “It is very important to emphasize that today’s decision is also not the result of any error or conduct on the part of the Special Prosecutor’s Office, the trial court or the Department of Chicago police.”

He added that Smollett “did not even challenge the sufficiency of the evidence against him in his appeal.”

Smollett was released after the Illinois Supreme Court ruled that his rights were violated by Webb and his team’s decision to retry him even after the original charges were dropped with an agreement that he would not be not charged again.
