Philadelphia DA sues Elon Musk and his super PAC over $1 million sweepstakes

The Philadelphia district attorney on Monday asked a state judge to shut down tech billionaire Elon Musk’s company. controversial million dollar gift to registered voters, calling it an “illegal lottery system.”

Philadelphia District Attorney Larry Krasner, a Democrat, filed a civil action against Musk and his pro-Trump group, America PAC.

“The America PAC and Musk are urging citizens of Philadelphia – and other members of the Commonwealth (and other swing states in upcoming elections) – to give up their personally identifiable information and make a political commitment in exchange of a chance to win $1 million,” the report said. the lawsuit alleges. “It’s a lottery. And it is undoubtedly an illegal lottery.

A spokesperson for Musk’s super PAC did not comment on the lawsuit and instead highlighted the group’s latest $1 million winner, announced Monday — a registered voter from Hastings, Michigan.

A judge has scheduled a hearing on the matter for Friday, meaning Musk’s sweepstakes could continue at least through the week, although Krasner’s office could request an expedited hearing. The case was assigned to Judge Angelo Foglietta, a Democrat.

In the lawsuit, Krasner’s office argues that Pennsylvania law requires all lotteries to be “operated and administered by the state” — and that Musk’s $1 million daily donation must be stopped because it operates outside of these legal safeguards.

“Although Musk says that selecting a winner is ‘random,’ this appears false because several selected winners are individuals who showed up at Trump rallies in Pennsylvania,” the lawsuit states, arguing that the lottery’s rules are “misleading”.

The case is based on Pennsylvania’s lottery and consumer protection laws. Krasner said his lawsuit was not about state and federal laws prohibiting vote buying.

The US Department of Justice also warned Musk’s super PAC believes his gift could violate federal laws that criminalize offering money for voter registration.

The owner of X and CEO of Tesla, who lent his support to the former president Donald Trump and spending millions of dollars to support his candidacy, publicized his political action committee’s $1 million prize aimed at increasing voter registrations in hotly contested states.

Musk’s initial promise to pay prizes to registered voters immediately sparked concerns from election law experts and some state officials, who questioned whether it broke the law.
