Man convicted of child neglect after baby found unconscious and tested positive for meth exposure

CHARLESTON, W.Va. (WSAZ) – A man was convicted Wednesday on drug and child neglect charges.

David Lee Mallo, 27, of Saint Albans, West Virginia, was convicted of child neglect causing serious bodily injury, two counts of child neglect creating substantial risk of bodily injury and simple possession of a controlled substance under a guilty plea.

According to court documents, on June 21, 2024, members of the Kanawha County Sheriff’s Department were dispatched to Saint Albans after David Mallo reported finding his 5-month-old child unresponsive.

An officer went to CAMC Women and Children’s Hospital and was informed that the child was brought in with a temperature of 105 degrees and tested positive for methamphetamine.

Due to the child’s condition, officers went to Mallo’s home for further investigation.

Mallo showed impairment during several field sobriety tests, officers said.

After the tests, Mallo allowed police to search the house.

Throughout the search, officers found suspected methamphetamine.

Mallo is scheduled to be sentenced on January 8, 2025, and faces a maximum sentence of imprisonment in a state correctional institution for up to 11 years and 6 months.
