Indiana University updates protest policy

INDIANAPOLIS (WISH) — Indiana University Program Updates expressive activity policy are intended to help students understand what is and is not allowed at night.

Under this clarified policy, demonstrations, giving speeches, circulating petitions and any other unapproved activities are prohibited between 11 p.m. and 6 a.m.

The updated policy allows:

  • Spontaneously and simultaneously collect and distribute literature between 11 p.m. and 6 a.m.
  • Events scheduled or authorized by IU that extend between 11 p.m. and 6 a.m.
  • Events taking place between 11 p.m. and 6 a.m. that have received prior written approval from the appropriate university office.

These changes occur after July Updates this specified that any temporary structure must be approved at least ten days before the demonstration.

The American Civil Liberties Union (ACLU) filed a lawsuit against an earlier version of the policy, saying it violated the First Amendment.

The board first restricted the use of temporary structures, such as tents, on April 24.

It was the day before a pro-Palestinian demonstration, where 33 people were arrested for using temporary structures during a demonstration.

The July update also banned in-ground signs, chalk spraying, outdoor amplified sound and camping without approval.

In a press releaseIU Vice President and General Counsel Anthony Prather provided the following statement:

“Since the policy came into effect, we have received questions about how it applies to different events taking place on our campuses. These changes aim to answer these questions and increase clarity so that those who wish to exercise their rights know what is allowed and what is not.

The school says this updated policy provides specific times when certain acts are prohibited to ensure that “the educational mission or operations of the university are not disrupted.”
