Community members concerned about sex offenders returning to New Berlin

NEW BERLIN — Concerned members of the New Berlin community packed City Hall Wednesday night to hear about a sex offender returning to the area.

“Completely unacceptable,” said concerned community member Darren Krueger.

Krueger was given one day’s notice of this meeting to discuss Nicholas Weaver’s release from prison on November 19.

Court records show Weaver served a year and a half sentence for inciting sexual contact with children.

“There are tons of kids in this neighborhood. There are tons of kids in New Berlin and again, it’s unacceptable for this offender to live near these kids,” Krueger said.

The house Weaver returns to is less than 500 feet from Weatherstone Park. That’s where investigators say he sexually assaulted a 14-year-old girl in 2019.

“Close to the park that this happened in and, secondly, less than a mile from a school, this is completely stupid. It makes no sense and should not be allowed under any circumstances,” said Kruger.

According to this new order from Berlinsex offenders cannot live within 500 feet of a child safe place.

However, Weaver lived on site before the law was passed. The city says he is allowed to return.

“Essentially, he was grandfathered in,” said a New Berlin police officer.

Neighbors tell TMJ4’s Megan Lee they want the loophole closed.

“To hell with grandfathering. We can’t grandfather criminals,” Krueger said.

“Why are we allowing sex offenders into our community? My answer is simple: By banning any sex offender from entering our community, the Supreme Court would say it’s unconstitutional,” explained a New Berlin police officer .

Police said Weaver will be under strict GPS monitoring when he returns to the community.
