Experts predict Trump will tap his own Supreme Court appeals judges if he retires

President-elect Trump he can be expected to stick to his previous judicial philosophies when looking for a potential Supreme Court nominee if a justice retires from the high court, experts say.

Trump appointed three judges to the Supreme Court, all three aged under 55 at the time of their appointment. Likewise, Trump appointed more than 50 federal appellate judges during his first term.

Politicians and media figures have called for the resignation of the court’s longest-serving justices, particularly Justices Clarence Thomas and Samuel Alito, in anticipation of a Trump presidency. Such calls were also made to Justices Sonia Sotomayor and Elena Kagan before the general election. Politico recently reported that Democrats were discussing whether Mayor of Soto should resign during their remaining two months in control of the Senate.

“No one but Justices Thomas and Alito knows when or if they will retire, and referring to them as meat that has reached its expiration date is reckless, ill-informed and, frankly, just plain rude.” , conservative legal activist Leonard Leo told Fox News Digital. in a statement. “Justices Thomas and Alito gave their lives to our country and our Constitution and should be treated with more dignity and respect than some experts give them.”

Trump could have an opportunity to further strengthen the conservative majority by appointing younger judges if some of them retire.

“I think you can start counting the days until Thomas retires,” said Devon Ombres, senior director of courts and legal policy at CAPAction. When asked where Sotomayor and Kagan stood, Ombres replied, “They’re not leaving now.”

“We are already starting to see conservative activists speaking out in favor of retiring Justices Alito and Thomas so that President Trump can replace them with nominees in their 50s, in order to preserve conservative majorities for the next 15 to 20 years . court,” John Yoo, the Emanuel Heller Professor of Law at the University of California, Berkeley, told Fox News Digital.

Yoo noted, however, that even if such retirements were to take place, the balance of the court as it currently stands would remain the same.

“It’s not clear to me that they should retire,” Yoo said. “They’re about 75 years old and they both look healthy. And they’re both in top form.”

“I think Trump, given his practices, would probably favor appointing people that he had already appointed to the circuit courts,” Yoo said. “And he has a lot of choices because he chose a lot of young conservatives.”

Shadows specifically mentioned Fifth Circuit Judges James C. Ho and Stuart Kyle Duncan as potential Trump nominees to the Supreme Court. Of the court’s 17 active judges, six were appointed by Trump.

In anticipation of his first administration in 2016, Trump released a list of potential Supreme Court nominees. It was later expanded before that year’s general election, and again in 2017. The list turned out to be a tactic to appease the minds of the republicans concerned about Trump’s ability to appoint conservative judges to the court.

Yoo said he didn’t expect Trump to repeat himself this time with an updated list.

I think the last time he did it, he was trying to convince the Republican Party, and he was an outsider. No one knew if he was conservative or not. And so, he released that list,” Yoo said. “And so, it’s actually pretty smart of Trump at that time to release the names and stick to it as people that he would appoint to the Supreme Court because it really committed him. in the minds of conservatives.

“And he kept his word. And I think he doesn’t need it now because people can see his track record.”
