Supreme Court issues interim order to prevent removal of executive director of foreign employment board Uprety

The Supreme Court has passed an interim order restraining the removal of Foreign Employment Board Executive Director Dwarika Prasad Uprety from the post. The single bench of Justice Bal Krishna Dhakal issued the order in response to the Ministry of Labour, Employment and Social Security’s decision to relieve Uprety of his duties.

Uprety, appointed by the Council of Ministers on August 23, 2022 for a four-year term, had received a three-day notice of explanation from the ministry on October 22, 2024. Before the end of the explanation period, he was dismissed of its functions. role, an action that the Supreme Court found to be inconsistent with the Foreign Employment Regulations. The top court ruled that Uprety’s premature dismissal could constitute a violation of his rights, as his tenure was defined by administrative obligations specified in the Foreign Employment Act of 1985.

The order requires Uprety’s position to be maintained in its original status until a final decision on the petition, prohibiting any action that would implement the department’s termination letter.
